Leicester man cited for aggravated assault

LEICESTER — A Leicester man pleaded innocent on Monday in Addison Superior Court, criminal division, to a felony charge of aggravated domestic assault with a weapon, after he allegedly struck a woman on March 6 and — while brandishing a crowbar —  threatened to “bury her somewhere.”
Jason M. Kimball, 47, faces a penalty of up to 15 years in prison and/or a fine of up to $25,000 if convicted of the offense.
A court affidavit filed by Vermont State Police Trooper Eden Neary states that the charge against Kimball stems from a reported family fight that he and other state police officers were asked to investigate at a home on Bullock Road in Leicester on March 6. Police were informed, while en route, that the alleged victim had left the scene to be with a family member.
The alleged victim told police that she and Kimball — her former boyfriend — had had an argument that day, according to court records. During the course of that argument, Kimball allegedly kicked over a coffee table in the woman’s direction, then allegedly grabbed her and knocked her to the ground when she tried to gather some belongings to leave for the night, according to court records.
“(The victim) said Kimball tried taking a bag from her and was unable to, therefore Kimball reached into (the victim’s) pants and ripped her underwear from her,” Neary’s affidavit states. “(The victim) said when she got up, Kimball began throwing her around the room and punching her in the head and spitting in her face.”
At one point, the woman said she was able to use a phone to call for assistance, whereupon “she feared for her life when Kimball threatened to bury her and then came after her with a crowbar in his hand,” according to court records.
Neary reported observing redness on the right side of the victim’s face, near her eye, according to his affidavit.
State police said they located Kimball at his home on March 7 and arrested him.
