Newton cleared in election complaint

MIDDLEBURY — An election complaint filed with the U.S. Office of Special Counsel about Peter Newton, the Democratic and Republican nominee for Addison County Sheriff, has been closed with no action being taken.

“Because he is not currently covered by the Hatch Act and we have no evidence that his violation was knowing and willful, we have decided to close our file without further action,” Erica S. Hamrick, deputy chief in the Office of Special Counsel wrote about Newton.

Campaign violation alleged against sheriff candidate Newton

MIDDLEBURY — A complaint has been filed with the U.S. Office of Special Counsel as to whether Peter Newton, a lieutenant in the Addison County Sheriff’s Department, is eligible to run for county sheriff because a portion of his police salary was paid through a federal grant before his campaign began.

Sheriff Don Keeler, who is not seeking re-election, and Newton said this week there is no basis for the anonymous complaint under what is known as the federal Hatch Act.

Affidavits tell backstory of alleged Vergennes robber

BURLINGTON — A Texas man who police say stole more than $6,000 during a stick-up at a Vergennes market as part of a cross country armed robbery spree pleaded not guilty in U.S. District Court in Burlington last week.

Mark Triolo, 46, was shot by police in Brattleboro on May 4, three days after the armed holdup at the Small City Market in Vergennes.

Triolo also is a suspect in two armed robberies in Southern Vermont both within an hour before the shooting by Brattleboro and Vermont State Police, records show.

Porn defendant ordered detained again

BURLINGTON — A 20-year-old Addison County man who was released while awaiting trial on federal charges of distribution of child pornography and assault on an investigator is back behind bars after violating his conditions of release.

Colin Germain, who was allowed to live with a guardian in Orwell, was ordered jailed by Federal Magistrate Judge John M. Conroy during a brief hearing in U.S. District Court in Burlington on May 19.

Addison couple lose in Vt. Supreme Court

ADDISON — The Vermont Supreme Court has upheld a $27,213 civil fine imposed by the Environmental Court against three property owners in the town of Addison.

Barbara Ernst, her partner Barbara Supeno and her brother Francis Supeno had appealed the state order imposing a $27,213 penalty for both water and wastewater permit violations on their waterfront property on Lake Champlain.

The high court on Friday ruled the $27,213 fine was proper in light of the conduct of the three defendants.

Police find 61 cell phones at New Haven home, charge man with child porn

BURLINGTON — A New Haven man is facing federal charges of distribution of child pornography and assaulting a federal agent during a court-ordered raid at his Addison County home.

Colin Germain, 20, of Twitchell Hill Road appeared briefly in U.S. District Court in Burlington on Friday, March 9. His case was continued until Wednesday afternoon at the request of Assistant U.S. Attorney Nicole P. Cate. This week the defense asked for a two-day delay because Germain has been given a new guardian.

Feds charge Bristol man with child pornography

BRISTOL — A 26-year-old Bristol man on Friday pleaded not guilty to a federal charge of making child pornography following a raid at his home.

Cody Clark, who resides at the Kountry Trailer Park, was arraigned in U.S. District Court in Burlington on a charge of enticing a minor to engage in sexually explicit conduct for the purpose of allowing the defendant to produce a visual depiction. The indictment alleged that the conduct happened between Jan. 21, 2014, and Sept. 2, the day the federal authorities conducted a court-ordered search at his trailer, records show.

Former deputy sheriff files lawsuit for wrongful termination

BURLINGTON — A former Addison County deputy sheriff maintains he was fired from his job last year after he believes comments he made during a secret session of the Leicester selectboard were later shared with his boss, Sheriff Donald Keeler Jr.

Mark Stacey filed a civil lawsuit in U.S. District Court in Burlington last week claiming a wrongful termination by Keeler and the Addison County Sheriff’s Department.

N.Y. man caught with heroin stash and over $13,000 in cash

MIDDLEBURY — About 18 grams of heroin and $13,725 in cash have been seized following a traffic stop by the Addison County Sheriff’s Department, court records show.

Lamont Hudgkins, 35, of Staten Island, N.Y., has pleaded innocent in Vermont Superior Court, criminal division, in Middlebury to charges of heroin trafficking, conspiracy to traffic in heroin and possession of 10 ounces of marijuana — all felonies. He was initially jailed for lack of $75,000 bail, but has since been released on a bail bond with conditions.

Community Forum: Vermont Legislature correct to approve shield law

This week’s writer is Mike Donoghue, executive director of the Vermont Press Association.

The Vermont Press Association praises and thanks the Vermont Legislature for approving a shield law designed to protect journalists from unwarranted subpoenas concerning their sources.

The House of Representatives gave final approval to the legislation, 140-2, on Thursday afternoon and is sending the measure to Gov. Phil Scott for his signature.
